KINDE THE Suffary, freedom of expression, and freedom of the press are human rights protected by Pancasila, the 1945 Constitution, and the UN Universal Declaration of Human Rights. Existence Cyber media Indonesia is also part of freedom of opinion, freedom of expression, and freedom of the press.
Cyber media has a special character so that it requires guidelines so that its management can be implemented professionally, fulfilling its functions, rights, and obligations in accordance with Law No. 40 of 1999 on the Press and the Journalistic Code of Ethics. For this reason, the Press Council together with press organizations, cyber media managers, and the public drafted the Cyber Media Guidelines as follows:
1. Scope
a. Cyber Media is any form of media that uses internet vehicles and carries out journalistic activities, as well as meeting the requirements of the Press Law and Press Company Standards set by the Press Council.
b. User Generated Content is any content created and or published by users of cyber media, among others, articles, images, comments, voices, videos and various forms of uploads attached to cyber media, such as blogs, forums, reader or audience comments, and other forms.
2 Verification and balance of news
a. In principle, every news must be through verification.
b. News that can be detrimental to other parties requires verification on the same news to meet the principles of accuracy and balance.
c. The provisions in item (a) above are excluded, with the conditions:
1) News really contains an urgent public interest;
2) The first source of the news is a source whose identity is clearly mentioned, credible and competent;
3) News subjects that must be confirmed are not known where they are and or cannot be interviewed;
4) The media provides an explanation to the reader that the news still requires further verification that is sought in the future. The explanation is contained at the end of the same news, in brackets and using italics.
d. After loading the news in accordance with the item (c), the media must continue the verification effort, and after verification is obtained, the verification results are listed on the update news (update) with links to unverified news.
3. User Generated Content (User Generated Content)
a. Cyber media must include terms and conditions regarding User Generated Content that do not conflict with Law No. 40 of 1999 on the Press and the Journalistic Code of Ethics, which are placed brightly and clearly.
b. Cyber media requires each user to register a membership and log-in process in advance to be able to publish all forms of User Generated Content. The terms regarding log-in will be further regulated.
c. In such registration, the cyber media requires the user to give written consent that the User Generated Content is published:
1) Does not contain false contents, slander, sadistic and leecene;
2) Does not contain contents containing prejudice and hatred related to ethnicity, religion, race, and intergroup (SARA), and advocate for acts of violence;
3) Does not contain discriminatory content on the basis of differences in gender and language, and does not demean the dignity of the weak, poor, sick, mentally disabled, or physically disabled.
d. Cyber media has the absolute authority to edit or delete User Generated Content that is contrary to item (c).
e. Cyber media must provide a User-made Content complaint mechanism that is considered to violate the provisions of the item (c). The mechanism must be provided in a place that is easily accessible to the user.
f. Cyber media must edit, delete, and correct any User-made Contents reported and violate the provisions of item (c), as soon as possible proportionately no later than 2 x 24 hours after the complaint is received.
g. Cyber media that have compliant provisions on item (a), (b), (c), and (f) are not liable for problems caused by content loading that violates the provisions of item (c).
h. Cyber media is responsible for the User-made Contents reported if they do not take corrective action after the deadline as stated in item (f).
4. Inrelation, Correction, and Right of Answer
a. The error, correction, and right of reply refer to the Press Act, the Journalistic Code of Conduct, and the Guidelines of the Right of Answers established by the Press Council.
b. The error, correction and or right of reply shall be linked to the news that is corrected, corrected or given the right of reply.
c. In any news of the error, correction, and right of reply must be listed the time of loading the rounding, correction, and or right of reply.
d. If a particular cyber media news is disseminated by another cyber media, then:
1) The responsibility of the cyber media of the news maker is limited to the news published in the cyber media or cyber media under its technical authority;
2) News correction carried out by a cyber media, must also be done by other cyber media that quotes news from the corrected cyber media;
3) Media that disseminate news from a cyber media and does not make corrections to the news according to the cyber media carried out by the owner and or news maker, is solely responsible for all the legal consequences of the news that is not corrected.
e. In accordance with the Press Act, cyber media that does not serve the right of reply can be punished with a maximum penalty of Rp500,000,000 (five hundred million rupiah).
5. News Revocation
a. News that has been published cannot be revoked for reasons of the incident from outside the editor, except related to the issue of SARA, morality, the future of the child, traumatic experience of the victim or based on other special considerations set by the Press Council.
b. Other cyber media must follow the revocation of news excerpts from the media origin that has been revoked.
c. Revocation of the news must be accompanied by the reason for revocation and announced to the public.
6 Advertising
a. Cyber media must distinguish firmly between news and advertising products.
b. Any news/article/fill that is an advertisement and or paid content must include the caption ‘advertorial’, ‘advertising’, ‘ads’, ‘sponsored’, or other words that explain that the news / article / content is advertising.
7. Copyright
Cyber media must respect the copyright as stipulated in the applicable laws and regulations.
8 Inclusion of Guidelines
Cyber media must include the Guidelines for the News of Cyber Media in its media clearly and clearly.
9. Disputery
The final assessment of the dispute regarding the implementation of the Cyber Media Reporting Guidelines was resolved by the Press Council.
